iskoniq Terms of Service

Version 1.0 ยท Effective October 12, 2026

1. About these Terms

These Terms are a contract between you and the company that provides iskoniq and charges you, as named on your checkout page and invoice ("iskoniq", "we", "us"). "You" means the coach or organisation that uses iskoniq. If you accept these Terms for an organisation, you confirm you can bind it. iskoniq is intended for business and professional use.

2. Definitions

Service: the iskoniq website, web app and everything we provide through them.

Coach: a communication or public speaking trainer or coach who uses the Service.

Client: a person a coach works with, whose sessions the coach uploads.

Organisation: a company or school that uses the Service for several coaches or a team.

Manager: a person an Organisation adds on the Business plan.

Session: the analysis of one person in one uploaded recording.

Your Content: recordings, notes, brand assets and anything else you or your users upload.

Output: measurements, written insights, practice drills, chat answers and reports the Service produces.

3. Accounts and how the contract is made

You must be at least 18. Keep your login details safe and tell us at once if someone else has used them. You are responsible for the people you add to your account.

When you first log in, you accept these Terms by ticking a box. If you choose a paid plan, you see the plan, the price, the billing period and how renewal works before you pay, and you can correct your details before you confirm. These Terms are concluded in English.

4. Plans, sessions and limits

4.1 Each plan includes a number of Sessions per billing period and a maximum recording length, as shown on our pricing page when you subscribe. Each recording can be up to 500 MB. In a group recording, each participant who is analysed counts as one Session.

4.2 A Session counts only when a report is successfully generated. Failed analyses, and regenerating the written part of a report, do not use a Session.

4.3 Unused Sessions from your monthly allowance carry over to the next month only. For example, if your allowance is 10 and you use 8, the remaining 2 carry over, so you have 12 Sessions the following month. Sessions that were carried over expire at the end of that month and do not carry over again.

4.4 Extra Sessions can be bought in packs, as shown in the product. They can only be used while you have an active plan. They are valid for 12 months from purchase or until your plan ends, whichever comes first, and follow the recording length limit of your current plan.

4.5 Sessions are used in this order:

  1. Extra Sessions, starting with the ones that expire first;
  2. Sessions carried over from the previous month;
  3. your allowance for the current month.

4.6 If you cancel your plan, you can keep using all your Sessions (monthly allowance, carried-over and extra Sessions) until the end of the billing period you have already paid for. When your plan ends, all unused Sessions expire, including extra Sessions. They cannot be restored, even if you start a plan again.

4.7 Coaches can edit the written part of a report and hide sections before publishing. Measurements cannot be edited. Reports stay in review until the coach publishes them.

4.8 If we add Sessions or features to your plan, this applies immediately.

5. Billing, renewal, plan changes and cancellation

5.1 Prices are in USD and exclude applicable taxes, which are added where required.

5.2 You pay in advance, monthly or yearly. Your subscription renews automatically for the same period until you cancel.

5.3 You can cancel anytime in your account. Cancellation takes effect at the end of the period you have paid for, and you keep access until then.

5.4 Upgrades take effect immediately. We charge the prorated difference for the rest of the current period, and your renewal date stays the same. Sessions already used in the current period count towards the new allowance. If the upgrade payment fails, the upgrade is not applied.

5.5 Downgrades take effect at the end of the current billing period, without a refund for that period. You cannot downgrade in the same billing period in which you upgraded.

5.6 Switching from monthly to yearly takes effect immediately with a prorated charge. Switching from yearly to monthly takes effect at the end of the yearly term.

5.7 If you are on a plan or price we no longer offer, you keep it while your subscription stays active. If you change plans, current plans and prices apply. This does not affect founding pricing under section 7.

5.8 Before a yearly renewal, we email you a reminder with the amount, the date and how to cancel.

5.9 Failed payments, refunds and the money-back guarantee are described in our Refund and Billing Policy, which forms part of these Terms.

6. Price changes

6.1 We may change prices. We tell you by email at least 30 days before a new price applies to you. The new price applies from your next billing period after that notice, and you can cancel before it applies.

6.2 Yearly plans keep their price until the end of the paid year.

6.3 Reducing what a plan includes, such as fewer Sessions or a shorter recording length, is treated the same as a price increase.

7. Founding Program

7.1 Founding members get their first 5 Sessions free, without a payment card. Free Sessions never turn into a paid subscription unless you choose a plan and confirm payment.

7.2 Your founding price is locked for 36 months from your first paid month, on every plan you choose during that time, as long as your subscription stays active.

7.3 During those 36 months, your founding price is never higher than our public price for the same plan, and your plan never includes less than it did when you joined.

7.4 After 36 months, the prices in effect at that time apply. We tell you at least 30 days in advance, and you can cancel before the change.

7.5 Founding pricing ends if your subscription is cancelled, including after failed payments. If you subscribe again later, the prices in effect at that time apply.

7.6 If you take the money-back refund in your first paid month, your founding place ends.

7.7 We ask founding members to use iskoniq on real sessions and share honest feedback, and, if they are satisfied, a testimonial. We never ask for a positive review, and we publish a testimonial only with your written permission.

8. Your Content and Outputs

You keep ownership of Your Content. Your Clients keep whatever rights they have in their own voice and image. You give us permission to host, process and display Your Content only as needed to provide, secure and support the Service for you. We do not use Your Content or Outputs to train AI models, and we do not use them in our marketing without your written permission. You may brand Outputs with your own name and logo and share them with your Clients.

9. Recordings and consent

Before you record or upload a session, you must:

  1. have the consent of every person in the recording, where the law requires it, and a legal basis to record it. In some places, including several US states, everyone in a conversation must consent;
  2. tell the people in the recording that iskoniq will analyse it and who will see the report, including Managers on the Business plan;
  3. have written consent from a parent or guardian before recording anyone under 18;
  4. avoid uploading sessions with sensitive information, such as health information, unless you have a legal basis for it;
  5. answer your Clients' requests about their data. We help you do this.

When you upload, you confirm that you have the required consent.

10. How the Service may not be used

You must follow our Acceptable Use Policy. In particular, you must not use iskoniq or its Outputs to make or support decisions about hiring, performance ratings, promotion, pay, grades or dismissal, or to monitor employees or students. iskoniq does not identify or infer emotions, and you must not use it, or connect it to other tools, for that purpose.

11. What Outputs are

Outputs are produced automatically and can be wrong or incomplete, especially with poor audio. They support your professional judgement and do not replace it. Review every report before you publish it. Outputs are not medical, psychological, speech therapy or diagnostic advice. The chat with a report is an AI system. We do not promise any particular result. If an analysis is wrong because of how we processed it, tell us and we re-run it at no cost.

12. Organisations and Managers

On the Business plan, the Organisation controls who has access. Managers can see reports that coaches publish for their team. The Organisation is responsible for telling its team members about this and for having a legal basis for it.

13. Our property and feedback

The Service, our software, report designs, name and logo belong to us or our licensors. While your subscription is active, you may use the Service for your work under these Terms. If you send us feedback, we may use it freely.

14. Data protection

For session data, you are the controller and we are the processor. Our Privacy Policy explains how we handle the data we control. A data processing agreement is available on request at support@iskoniq.com.

15. Availability and changes to the Service

We work to keep the Service available but cannot promise it will never be interrupted. We may improve or change features, but we will not materially reduce the core features of your paid plan during a period you have already paid for. Support is at support@iskoniq.com.

16. Consumers

If you use iskoniq as a consumer, nothing in these Terms limits your rights under mandatory consumer law, including any right to withdraw from an online contract within 14 days.

17. Suspension and ending the contract

You can end the contract anytime by cancelling. We may suspend or end your access if you seriously breach these Terms, if payment is overdue after we have warned you, if the law requires it, or if your use puts the Service or other people at risk. Where we can, we warn you first. After the contract ends, you can export your data for 30 days, and then we delete it.

18. Warranties

We provide the Service with reasonable skill and care. Beyond that, and as far as the law allows, the Service is provided as it is.

19. Liability

Neither of us is liable for indirect or consequential loss, such as lost profit. Our total liability under these Terms is limited to the greater of USD 100 and the fees you paid us in the 12 months before the claim. These limits do not apply where the law does not allow them, such as for intent or gross negligence, or to mandatory consumer rights.

20. Your responsibility for uploads

If someone makes a claim against us because you uploaded content without the required consent, or breached section 9 or 10, you cover our reasonable costs and losses from that claim.

21. Changes to these Terms

If we make a material change, we tell you by email or in the product at least 30 days before it takes effect. If you do not agree, you can cancel before that date and we refund the unused part of any prepaid fees. Small changes that do not affect your rights take effect when published.

22. Notices and reporting content

Formal notices go to support@iskoniq.com. Messages in chat are not formal notices. To report content you believe is illegal or infringes your rights, write to support@iskoniq.com with why, where it is, and your contact details. We review reports without undue delay and tell you what we decided.

23. Governing law and disputes

These Terms are governed by the law of the country where the company named on your invoice is registered. If you are a consumer, you also keep the protection of the mandatory law of the country where you live. Before going to court, we both try to solve a dispute in good faith within 30 days of written notice.

24. General

These Terms and the policies linked here are the whole agreement between us. If one part is invalid, the rest still applies. Neither of us is liable for delays caused by events outside our reasonable control. We may transfer this contract to a successor of our business, and we will tell you at least 30 days in advance.
